By engaging in a charter booking or by utilizing our Service, you consent to comply with these Terms. Should you object any section of these Terms, you are not authorized to use the Service.

2. Service Overview

OpenInformationHub specializes in offering top-tier yacht chartering services, inclusive of, but not restricted to:

• Yacht rentals for the day
• Evening yacht tours
• Business retreats
• Exclusive events
• Extended sailing adventures

Availability and meteorological conditions can affect all services. We retain the authority to alter or cease services without prior notice.

3. Arrangements and Confirmations

3.1 Reservation Procedure

To reserve a charter, you are required to:

• Be no younger than 18 years old
• Supply truthful and complete details
• Remit the necessary deposit as delineated in your reservation confirmation
• Concur with these Terms & Conditions

3.2 Verification

A booking gains verified status once payment has been made and you receive our written endorsement. We maintain the authority to decline service at our sole discretion.

3.3 Accessibility

Charter availability is contingent upon both ship availability and favorable meteorological conditions. We shall endeavor to meet your requested scheduling preferences.

4. Payment Terms

4.1 Pricing

All quoted prices are in € and are inclusive of any applicable taxes unless specified otherwise. Prices may be adjusted without prior notice.

4.2 Payment Schedule

• Deposit: A requirement of 50% of the full charter cost is needed at the time of reservation
• Balance: The remaining amount is required 48 hours before the scheduled departure of the charter
• Additional fees (if applicable): Payable upon the charter's conclusion

4.3 Payment Methods

We accept a variety of payment forms, including major credit cards, wire transfers, and bank-certified checks. Payments are securely processed using encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If cancelled more than 72 hours prior to departure: The customer receives a full refund except for any service charges.
• Cancellation between 24 to 72 hours before departure results in a 50% refund.
• Cancelling less than 24 hours before departure will not be eligible for a refund.

5.2 Weather Cancellations

Should our captain determine the weather unsafe for travel, options will be:

• Rebooking the client’s outing to the soonest available slot without additional charges.
• Issuing a full refund when rescheduling is unfeasible.

5.3 Mechanical Issues

In case the designated vessel develops mechanical issues, we will strive to arrange an appropriate replacement. If we cannot find an available substitute, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All individuals on board must adhere to the following:

• Comply with all directives given by the crew
• Utilize any provided safety gear when it is deemed necessary
• Disclose any health conditions that could potentially jeopardize their well-being
• Stay within specifically allocated regions on the ship

6.2 Prohibited Items

The next items are banned on the vessel:

• Items made of glass
• Substances that are against the law
• Weapons or any item that can be used as a weapon
• Excess amounts of beverages (beyond a moderate quantity)
• Animals (unless given permission beforehand)

6.3 Conduct

Passengers are required to behave with respect and decorum. Should anyone's actions pose a threat to safety or disturb the enjoyment of other individuals, we have the authority to call off the trip prematurely with no refund.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the cost of your charter service. We are not liable for:

• Injuries sustained due to personal carelessness
• Theft or destruction of personal belongings
• Indirect, incidental, or exemplary damages
• Delays resulting from inclement weather or events beyond our control

7.2 Insurance Coverage

We provide extensive marine insurance for our vessels and business operations. It is your responsibility to arrange personal travel and belongings insurance.

7.3 Assumption of Risk

When you take part in our charter services, you accept that marine activities come with inborn dangers, and you agree to be accountable for your safety and security.

8. Modifications and Itinerary Changes

We retain the authority to adjust travel plans, pathways, or timetables due to meteorological conditions, security reasons, or other necessary circumstances. Attempts will be made to offer alternatives of similar value.

9. Force Majeure

We cannot be held responsible for interruptions, postponements, or changes stemming from events that are out of our influence, such as, but not confined to:

• Extreme meteorological occurrences
• Catastrophic events
• Regulatory enactments
• Harbour terminations
• Breakdowns of machinery

10. Privacy and Data Protection

We handle your personal data as per our Privacy Policy. By utilizing our services, you agree to our collection and utilization of your information in line with the Privacy Policy.

11. Intellectual Property

The content present on our website, such as text, graphics, logos, and images, falls under the protection of copyright and intellectual property laws. Reproducing, distributing, or making derivative works is prohibited without explicit written consent from us.

12. Governing Law

The governing laws of Spain will apply to these Terms. Legal matters will be settled in the courts of Palma de Mallorca, Spain.
